These Terms of Service ("Terms") govern your access to and use of TrackPass (the "Service"), operated by TrackPass ("we", "us"). By accessing our website or using the Service, you agree to these Terms.
TrackPass is a guest list management platform that helps organizations import guest lists, send branded email invitations, track RSVPs, and check guests in via QR code.
Access to the application is provisioned per organization ("workspace"). You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
You agree not to use the Service to: send unsolicited bulk email in violation of applicable law, upload data you do not have the right to process, attempt to gain unauthorized access to the Service or other workspaces, or use the Service for any unlawful purpose.
Any guest or event data you upload ("Customer Data") remains your property. You are responsible for having the appropriate rights and consents to upload and process that data through the Service, including consent to email the guests you invite. We process Customer Data only to provide the Service to you.
Invitations and check-in emails are sent using a sender/SMTP configuration you provide and control. You are responsible for ensuring your use of that sender complies with applicable anti-spam laws (such as CAN-SPAM or equivalent) and the sender provider's own terms.
We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify or discontinue features of the Service from time to time.
We may suspend or terminate access to the Service for violation of these Terms. You may stop using the Service at any time.
The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, TrackPass will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
